Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Risefy platform, including the website at risefy.co, the application at app.risefy.co, and all related services (collectively, the “Services”). By creating an account or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Services. By using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@risefy.co if you suspect unauthorised access.

3. Subscriptions and Billing

• Free plan: we offer a free tier with limited usage and features. We may change the limits with reasonable notice.
• Paid plans: subscription fees are charged in advance on a monthly or annual basis. You authorise us and our payment processor (Paddle.com Market Ltd., which acts as the merchant of record and reseller of our Services) to charge the payment method on file at the start of each billing cycle.
• AI credit packs: one-time top-up purchases used to power AI generation and response processing. Packs are delivered to your account immediately and, once delivered, are non-refundable. See the Refund Policy for full details.
• Taxes: fees are exclusive of applicable taxes (such as GST), which will be added where required by law.
• Auto-renewal: subscriptions automatically renew at the end of each billing cycle unless cancelled before renewal.
• Failed payments: if we cannot charge your payment method, we may suspend or limit access until payment is received.

4. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

5. Your Content

You retain ownership of all content you create, upload, or generate through the Services (“Your Content”). You grant Risefy a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display, and process Your Content solely as necessary to provide and improve the Services.

You represent and warrant that:

• You own or have the necessary rights to Your Content.
• Your Content does not infringe any intellectual property, privacy, or other rights of third parties.
• Your Content complies with all applicable laws and these Terms.

6. Acceptable Use

You agree not to use the Services to:

• Violate any law, regulation, or third-party right.
• Send spam, phishing attempts, or other unsolicited communications.
• Upload, distribute, or generate content that is unlawful, defamatory, obscene, harassing, hateful, or that exploits minors.
• Reverse engineer, decompile, or attempt to extract source code from the Services, except to the extent permitted by applicable law.
• Probe, scan, or test the vulnerability of the Services or circumvent any security measures.
• Use the Services to build a competing product or service, or to resell the Services without our written permission.
• Submit data containing personal information of others without their consent and a lawful basis for processing.

We may suspend or terminate your account for violations, with or without notice depending on the severity.

7. AI-Generated Content

The Services include AI-powered features that generate content (questions, themes, layouts, summaries, etc.). AI output may be inaccurate, incomplete, or offensive. You are responsible for reviewing and approving all AI-generated content before publishing it or relying on it. Risefy makes no warranty regarding the accuracy or suitability of AI output.

8. Intellectual Property

The Services, including all software, design, text, graphics, and trademarks, are owned by Risefy or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services in accordance with these Terms. No other rights are granted.

9. Third-Party Services

The Services may integrate with or link to third-party services (such as payment processors, analytics, or social platforms). We are not responsible for those third-party services, and your use of them is governed by their own terms and policies.

10. Termination

You may cancel your account at any time from your account settings. Cancellation takes effect at the end of the current billing cycle. We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or use the Services in a way that could harm Risefy, other users, or third parties. On termination, your right to use the Services ends and we may delete Your Content after a reasonable retention window.

11. Disclaimers

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, Risefy and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services. Our aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) INR 5,000.

13. Indemnification

You agree to indemnify and hold Risefy harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, or your breach of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts located in Bengaluru, Karnataka shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms, except that we may seek injunctive or equitable relief in any competent court.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified at least 14 days before they take effect via email or an in-product notice. Continued use of the Services after a change constitutes acceptance of the updated Terms.
